On 19th of August I received a call from Sekar Reddy offering HMDA and RERA approved residential plot at Teegapur. He might taken my number from 99acre website as I was looking for residential plots on that website. He asked us for a site visit on 25th of August and we liked that Plot and negotiated for Rs 16200 per yard and on 27th we paid ₹11,000 as booking amount for that plot by scanning company provided QR. On 29th we paid ₹12,90,000 via credit card by taking verbal confirmation in the event of cancellation they will be providing full refund with in maximum 10 days. Till be paid total ₹13,01,000 everything was good. Post payment they started showing their true colour.

Before payment they said right after paying money, I will be getting sale agreement but post payment they postpone agreement to next day. On the next day evening after several calls and threat to cancel the deal they provided us sales deed on their company name which was wrong. That land doesn’t belong to them, and they do not even have POA to sell that land. Upton asking the same question, they initially discussed and refunded us ₹5,90,000 and promised to refund remaining amount by next day and asked us to pay complete money to Ameri space who the actual owner of that land.

Now days keep on passing and they keep on postponing. They did not even provide agreement nor refund. Upon asking them little tightly and threating them with police they said we can provide refund of only 80% that too after selling that land to someone. No proper commitment of proving refund till today.

We asked them to provide sales agreement for the money they hold which is ₹7,11,000 they refused and asked us to pay ₹5,90,000 in order to get agreement and promised us to provide 100% refund this time if we cancel deal or we won’t get 70% loan amount from bank. We asked them to give this in written but again they denied.

I kindly request you to help me and my wife in getting our money which is struck with them. We do not trust that company as they already cheated us and kept us on waiting for many days. Now we need our money to help my wife uncle who is suffering from pancreatic cancel.

Can anyone tell us whats the best option to get my money asap.

You are in a mess. Didn't it occur to you that you were supposed to make document verification before paying lakhs? Someone suggested you to file FIR, lawyer notice etc. they are useful in movies not in real life. This would be a civil case and probably your son or grandson will win the case.

Paying money to builder again is very risky. Just ask them for payment receipts instead of sale agreement. Try using those receipts for charge back.

Why still not filled FIR fir forgery and 420 ?

You should get your money first then do another deal.

These days builders are no 1 crook . 

And I think even police is also managed by these so called builders.

File a FIR/CASE which is necessary to get your money back as they will not refund money easily.

I went to 3 different police station to file complaint.

1st police station which is near my home denied to take complaint and asked me to file complaint where incident happned.

2nd police staiton denied by telling where incident happend that perticular location dosen't come under their jurisdiction and asked me to go to 3rd one.

3nd police station asked me to go to 2nd one.

Consult Prosecutor first, they give good advice & select such Prosecutor who has good network, atleast you have surity & go legal ways. Act fast, don't delay.

Unfortunately now it is a bit too late to ask.

You mentioned yourselves, your missus and her uncle in the post.

But prior to doing all this jugglery (QR codes, credit card payment)
whom did you consult?

Parents, senior colleagues, relatives, lawyers?

Who dafaq is Sekar Reddy and why in this post you are killing us by loose statements like: 'might have taken my number from"?

You pay someone more than 1.3 million without being sure of their credentials or how they got to you?

Even our milkman does not allow anyone to proceed without first properly identifying who they are, where they got his number from.

THIS even when all they want is to try the milk from his home dairy.

Did lord Vishnu or someone come and tell you that the papers are HMDA approved and RERA approved?
Or did you have your bankers, lawyers doing the verification?

How do we.. okay forget us.. how do YOU know that the property title is in the name of the entity that you think it is in the name of?

Without asking your background, capabilities or experience.. I ask you if you can ascertain that this game is not being played for the same patch of land.. with other victims?

Seems buying and selling N.A. (non agricultural) or even agricultural land is as routine thing for you as having dinner and lunch.

Now do not get us into the emotional trap and please you too do not think of your in-law's pancreatic cancer right now.

Unless bankers were involved in some loan that you took for purchasing this land,
now YOU have to separately hire a law firm or a lawyer.

If they (the other party).are some bigshots or acting as a front for land-mafia
then things will prolong unendingly in the gamut of court dates, appeals and cross appeals and higher courts.

And obviously India is the land of the pious and righteous.. so your lawyers and lawyers of the other party will never exchange greetings or information with each other and the judges or the court staff will never be swayed by money or power.

Forget that loop of 'now you pay so and so.. who is the real owner' and we will refund you upto N percent.

you are already in the debt of the card issuing company. Please JUST STOP🛑. No further financial transactions that side now

There is a saying: to not throw good money after bad.

Right now your possible write-offs is 'X'.
If I ask you to give me just 20% of X.. and the promise is that I recover ALL your X

then there are two likely outcomes.

      [2] you amount 'X' is recovered, albeit the partial payment to the third party is gone/ stuck i'm an.immovable asset.

      [1] you just made be richer by 20% of 'X'.

At this point, it would not hurt treating yourselves as being UNFIT to take any further major decisions on your own.

Better to loop i'm others who are somewhat fit.

Rather than directly approaching the police
usually lawyers or law student ld can better guide on how one can and when one should.. rather approach a magistrate and have the magistrate issue summons or orders.
That way, the IO (investigating officer) or the thana has to give the case.. that much more attention or at-least are accountable to the magisterial monitoring.

At ANY and EVERY point.. be VERY VERY careful to not let the police misguide you such or not act timely.. that anyone from the opposite camp seeks and gets anticipatory bail.

If needed, in latter stages, bribe whoever needs to be bribed but have the pressure mount on the other party/parties.

Do not think of all these things as avoidable expenses, but rather a cheap.MBA or other education which you are getting.

Promptly getting at-least 'some' police complaints filed.. I feel.. is the way to go.

If you are falling for cold calling for even property dealings (in the millions).. then those builder-politicians-police already have many other victims like you.

No use paying anything to them anymore.
Rather i would pay newspapers to carry the notice which my lawyers draft and seek other victim's assistance to come forward against the defendants.
(Newspaper advertising or space is not cheap, but then at-least for court purposes.. it is a proof.. that one was THAT serious and also desperate to find other victims.)

Since, you did payment online, first and foremost report to cyber crime portal. Use that to raise a dispute in your bank too.
