On 19th of August I received a call from Sekar Reddy offering HMDA and RERA approved residential plot at Teegapur. He might taken my number from 99acre website as I was looking for residential plots on that website. He asked us for a site visit on 25th of August and we liked that Plot and negotiated for Rs 16200 per yard and on 27th we paid ₹11,000 as booking amount for that plot by scanning company provided QR. On 29th we paid ₹12,90,000 via credit card by taking verbal confirmation in the event of cancellation they will be providing full refund with in maximum 10 days. Till be paid total ₹13,01,000 everything was good. Post payment they started showing their true colour.
Before payment they said right after paying money, I will be getting sale agreement but post payment they postpone agreement to next day. On the next day evening after several calls and threat to cancel the deal they provided us sales deed on their company name which was wrong. That land doesn’t belong to them, and they do not even have POA to sell that land. Upton asking the same question, they initially discussed and refunded us ₹5,90,000 and promised to refund remaining amount by next day and asked us to pay complete money to Ameri space who the actual owner of that land.
Now days keep on passing and they keep on postponing. They did not even provide agreement nor refund. Upon asking them little tightly and threating them with police they said we can provide refund of only 80% that too after selling that land to someone. No proper commitment of proving refund till today.
We asked them to provide sales agreement for the money they hold which is ₹7,11,000 they refused and asked us to pay ₹5,90,000 in order to get agreement and promised us to provide 100% refund this time if we cancel deal or we won’t get 70% loan amount from bank. We asked them to give this in written but again they denied.
I kindly request you to help me and my wife in getting our money which is struck with them. We do not trust that company as they already cheated us and kept us on waiting for many days. Now we need our money to help my wife uncle who is suffering from pancreatic cancel.
Can anyone tell us whats the best option to get my money asap.
You are in a mess. Didn't it occur to you that you were supposed to make document verification before paying lakhs? Someone suggested you to file FIR, lawyer notice etc. they are useful in movies not in real life. This would be a civil case and probably your son or grandson will win the case.
Paying money to builder again is very risky. Just ask them for payment receipts instead of sale agreement. Try using those receipts for charge back.
