Mobile NOT delivered & Amazon is Denying the Refund - NEED HELP!

Hello Everyone,

I recently ordered Realme Narzo 70 + Earbud (free) and both supposed to be delivered together but i only recieved the Earbud and Registered the complaint of Missing Mobile to Amazon. After 4 days of thier so called "Investigation", Today they denied the Refund.

I have decided to file the case in Consumer Court but What other options do i have to Apeal thier decision?

Points to Note:

1. Not full but i have Unboxing Video.

2. Delivery executive didn't do "Open Box Delivery".
when i called dlvry exe after i saw Missing Mobile. Infact, he asked me to inform that this box has Mobile and I need "Open Box Delivery". He upront has NO CLUE that this package NEEDS, OPEN BOX DELIVERY. 
Though other ecommerce like Flipkart's executive already know that They have to do "Open Box Delivery" at the time of delivery.

3. Delivery exe was NOT able to SCAN the QR code on Main Polythine Pack. So he had ask about STPT code to his Team/Senior to deliver.

4. Bill with the Earbud i recieved has Different Name, Order ID and Address. So i beleive this package was supposed to be for someone else.
and few more points i have. 

I informed all this points on the time of Registering compliant and When they denied the refund. But They had NOTHING to say about these. Talking like a well-trained robots, even seniors are all the same.
they have only one line : Investingation report says that product is delivered intact. hence we can not refund.

Please share your suggestions and experience! How to deal with this issue.

Consumer complaint will solve your problem. These days ecommerce platform behave like morons. They need strict action than only they help. As you have unboxing video and even bill os of different name. You will get what you deserve but you have to fight. 

In my case Flipkart denied the order delivery as price increased by 10000 for laptop but I complaint on consumer forum and got my laptop in 3 days.

So have patience and fight hard.

good old days of online shopping are over I guess, still remember buying mobiles from LetsBuy.com (later acquired by FK)/HomeShop18 etc in 2010-2011 where you used to get 5-15% off from site plus 10-15% card discounts which made me more confident to buy more things but still restricted to home appliances like AC/TV as was not confident on their delivery mode but now guess we need to go again back to pre-era of visiting showrooms and buying things offline mainly for peace of mind 😌

When you held the package did not you felt the weight being less then expected? 

What is the weight mentioned on packaging slip? Was it a OTP delivery? 

What does half unboxing video means?

1. didn't noticed at that time. 

2. 0.72kg and Dlvry person couldnt scan the bar code on Main packaging/label like normal delivery process. So he had to request STPT to his senior then that senior shared an OTP to me..  

3. Don't have the recording of openeing the main package (polythine) but have while opening the main Box, in which on Earbud was there.

4. Yes! Name and Order id is different. on the main package, it has my details. But the invoice i recieved with earbud has Different details.

You can raise your complaint at jago grahak jaago portal/file online FIR of cheating/theft you faced.

you would have checked the package weight and we need to take complete unboxing video in front of delivery guy for all the costly items. you proceed with consumer complaint.

Meanwhile, i am trying to register on https://consumerhelpline....in but everytime it sasy "Wrong Captcha". even thought it correct. May be any server issue.
My next step is to Register complaint online on above forum and any similar forum too. And will send direct email to seniors at Amazon.in

You can also try raising the chargeback with bank under service not delivered.

Now a days I do complete unboxing video of every package i receive.

U made a terrible mistake of not doing complete unboxing video.

I'll be extra careful from now on.

Btw few days ago I ordered a mobile from croma and it was good.

Trust me, when company don't want you to refund even Full unboxing video is useless.

In my case, from the date i registered complaint (amazon) to on thier resolution date. I was screaming to them that i have a Unboxing Video.


Still they all repeated the same line: Our investigation shows all the products delivered intact on the address. Hence we can not issue refund.

like fu***ng robots.. 


They didn't even care to look at the video once.. or any other proof as i mentioned in the post.

Proof will only help in fighting afterward.. NOT directly with Amazon, if they do not want to help.

Though ONE AMAZING thing Amazon said, on the date i was registering complaint:

I said: I have a unboxing video, which i want to send. So it will help in your investigation.

They said: Sir there is NO need of video. We TRUST OUR CUSTOMERS.

@stone_man Need suggestion.

I accidently added wrong Transaction id, while complain on consumerhelpline.gov.in

Now there is No option to Edit. Only saying to "Close the Grievance". 
So, should i close it and Submit a fresh case with correct details? 

I submitted it yesterday night only. So may be its not to late to close. What do you think?

This is what happened till now:

1. After several Social Post and Direct emails to their seniors including Jeff. I received an email from Executive team asking for proofs i have. Even after giving them all the proofs they denied the refund 2 days later.
Well, asking for proof was only Show-off with NO-intention to refund the money. They had already decided the answer based on their previous investigation.
Why i am saying this: because after sending them the proofs, i talked to customer care via Chat. I wanted to make sure they received my email with attachments. and They confirmed it but at the same time they also said "several times" that Investigation Report is final and they can NOT issue any refund. Even though they asked for the Proofs a day before.
So it was all a formality. 

2. Consumer Forum Online:
Amazon.in replied the same answer there. hence that case also got closed with No Refund.

3. I sent a legal notice and they confirmed the receipt. Its been 25 days almost, i don't have any update on it. 
Need to wait 30 days in total. since 30 days timeline was mentioned in the Notice.

My next step is to file a case in Consumer Court(e-daakhil).

Glad to know that you are not bowing down to their dictatorship. You will easily win this case in court, as you have all the proofs.

Also, don't forget to ask for compensation as well in court.  Keep on posting all of this on twitter as well, as if it goes viral then there will be lot of pressure on Amazon.

I am out of town from last 6 months. So didn't filed the case in Consumer court yet.
But i am determined to do that very soon.
