Incorrect credit txn in my bank acc related issue - Need tips

Hello dimers,

So the whole issue started as, some lady from Chirgaon (Jhansi) wrongly sent me 36000 in my ICICI bank account, through UPI on 25th Sep 2023.

  1. The lady promptly called ICICI & made complaint same day, ICICI put a lien of that amount (36k) on my account.
  2. The lady then made a separate complaint to Chirgaon cyber cell next day, following which ICICI put another lien of 36k on my account.
  3. The lady then again called Maharashtra police (cyber cell maybe) after few days (3rd Oct), made yet another complaint following which ICICI put yet another 36k lien on my account.

In her direct complaint to ICICI, she has mentioned "wrongly credited" as reason. But in both the police complaints, she mentioned "UPI fraud" as reason. Now this is offensive to me. I was sitting in my home chilling and suddenly for no reason, my name is tagged as a fraudster in police systems. ICICI branch clarified they can remove the lien only after receiving NOC from respective police departments.

PS:

  1. I do NOT know the lady who transferred me the money, never even talked to her in my life, no communication at all.
  2. I've also NOT transferred the said amount to any other account before it was blocked. Though I think I should've taken out the balance amount, as for receiving one wrong amount of 36k, my own 72k is blocked apart from that 36k.
  3. How to get rid of these repetitive complaints? Repetitive because there is only 1 credit transaction of said amount in my account, and also the reference RRN/UTR no. provided by the lady in all these complaints is same.

Any suggestions/tips how to proceed in such a scenario?

Any precautions I need to keep from my side? I've received that lady's contact details from the police complaint, but I've no intentions of reaching out to her directly as the lady already has made a fraud complaint against me even though it was her own mistake, no ideas what she'll claim in case I call her.

    There's nothing you can do in such cases. Apparently lady must be very influential (Political/Police deptt), due to which the Police acted so fast and took disproportionate measures. Otherwise even in case of much larger amounts police does not take any action if the victims are not well connected.

    The bank will also not act even though things may be clear, unless they receive a clearance from Police. 

    You can just go to the concerned police station and request them to expedite the resolution. But you may have to visit several times.

    Sadly that's the reality of our law and order machinery in our country.

    You also have the option of taking a rigid stance by escalating the issue thru cybercrime portal, highlighting the mistakes committed by blocking 3 times the amount and calling the mistake of the lady a fraud without any proper investigation. You can post the details on the Twitter handle of police commissioner

    You should contact lawyer and send notice to her demand compensation, do not leave her. 

    Also send notice to bank for holding your funds 3 times

    Write a formal complaint to ICICI , wait for 30 days and write to RBI BANKING OMBUDSMAN.. demand compensation for mental harrassment..

    Send a legal notice to her..as a new year gift..

    Can you try sending some amount to her bank account by mistake and put a tit-for-tat similar fraud UPI transaction complain against her?

    Agreed. This case shows how much important it is to have connectivity between departments and common sense at all levels. The lady very cleverly skipped this fact from police that she has already raised complaint to bank and amount has been blocked. Not once, but twice.

    I think police and cyber cell doesn't take wrong upi transactions so seriously so maybe someone suggested her to give complains in fraud section.


    There are 2 options for you now

    1. Call that lady and if she understands your situation then tell her to remove complains from cyber cell and police

    2. If she doesn't agree with you then file a case against him demanding compensation for wasting your precious time and disturbing you mentoly for her own mistake.

    But I'm not willing to call her, who knows tomorrow she will claim I called her up and threatened harm, I'll be even more in trouble as call recordings are not readily accepted by courts without forensic confirmation!

    Talk to the lady and Go to your nearest police station and and tell them you are willing to refund the amount and it was not fraud but amount sent by lady by mistake.

    Yes, that's what I've discussed with the cyber cell head of the police station where complaint was made, as his number was there in the complaint. But he is on leave till 5th and only after that matter can proceed. I got a tareekh even before reaching the court lol.

    really annoying but only one lesson from this is if some transcation u find as unknown transfer rest of amount to another bank account asap but if thats your primary account then 😥😥

    but what if other accounts that received the money are also blocked due to this. there's been stories of all accounts being blocked in which funds have been transferred from illegitimate sources. so if you receive money from someone who got it from an illegal source, both his and account will be blocked.

    Wow this is really crazy. I sent 8k wrong paytm upi once, complaint immediately to paytm (no lien), complaint to cyber cell (no update 5months passed)

    Since it was paytm I had his phone number where he was not willing to pay so I messed his life by putting every other day for a week on about 12/13th day got a call from him saying money has been refunded kindly stop spamming me with messages joy

    For UPI user old phonepe feature is lifesaver 

    One UPI id for all accounts linked to that number always keep it linked to some small bank like paytms nil bal account etc and whenever needed link it for few minutes if you want to receive account to any account and then after receiving money change account again by this way accidental credit chances will be very less

    Seems for new signups phonepe is forcing to create new UPI id for each linked account but I am enjoying single UPI id feature very beneficial in such cases

    Aur yeh fake complaint k chalte toh pakka Jail bhi hoga. Sirf compensation se baat nhi banega. 😀

    Register proper complaints with all authorities like Bank, Cyber Cell, etc with proper details and keep a copy of the same. 

    In this way, at least you will have proper proof/records if the situation gets worse. 

    The whole system is corrupt. So, you don't even imagine what could happen. So, take proactive action.

    Man wtf. These last 3 days seeing all these kind of fraud and money losses. 1st that whatsapp guy then that elderly grandpa's fd and now this.

    Now this case is epitome of sadness. Like how the f should i get punishment for what i didn't even know happened? And our stringent police who is working 24*7 for this case. While others money is pending from like 1 year(similar post of fund block by cyber shit guys) 

    Can't keep the money in home as malik is present and can't keep in bank as don't know who will torture me for their clumsyness

    To OP. As most have suggested above i strongly urge you file grievances with bank. That lady doing her thing but bank should be the responsible one. Case thok do. Don't talk to that lady she may call you rapist (the burden of proof lies on you i repeat don't call or contact. If you still wish get a lawyer and then do the proceedings in front of them)

    only lien... I'm able to use remaining balance.

    I'm also thinking to make official complaint to ICICI, but fully know they won't do sh*t to help me, even through I'm their customer since 12 years while the other person is not even their customer. They're more like escaping by saying that we only acted as per police complaints, go talk to police.

    6 months ago I have heard this type of account freeze issues.. from then im following these..

    1.i have seperated my primary account..

    2. Made sure no UPI credits in primary account.

    3.No self transfers to primary account..

    4.No transaction pattern between my primary and other accounts..

    Well, now you may not need to take such steps because

    As per reports, to reduce the growing cases of online payment fraud, it is expected that there will be a four-hour time limit for the first payment exceeding Rs 2,000 between users who haven’t transacted before.

    I suggest connecting with ur bank and ask why lein is there in ur account that too 3x.

    It is just a lein , and i believe after resolution the bank will release what is urs and transfers rest to the lady.

    Also, did u get a chance to access the fir what the lady filed against u, as she must have mentioned something like what kind of fraud..etc..

    Yes I had an hour long argument with branch people today on this only... they clearly said, 3 different complaints, hence 3 different blocks. Even they understand its not logical, but that's the only excuse they can give rather than accepting their mistake.

    The complaints are not FIRs per se, because these complaints were raised almost 2 months back but nobody from bank or police or even the complainant reached out to me. Not even once. Not even the police while registering the case. These are cyber cell complaints, do they equal a FIR, I do not know. But the complaint letter received by bank from police show that complaints were filed in 'UPI related frauds' category.

    I suggest making a harassment case against the lady + police + bank (all 3 at once, so that the guilty party can be found among them) and demanding a fine for the time wasted + compensation for harassment + mental abuse + court fees + lawyer fees.

    Lady: for harassment besides her own mistake & defamation for calling it fraud

    ICICI + Chirgaon cyber cell + Maharashtra police: For the power of abuse & negligence for duplicate freeze.

    Make an official police complaint in your state.

    My advice for preventing Bank freezing / bank frauds :-

    1) min. 2 mobile numbers & 2 email IDs - 1 no. Primary and others secondary.

    2) primary mobile number & email ID - All bank accounts & CC (except day-to-day usage bank account), very important government services - Aadhar, ITD, EPFO, etc and for ECS for any availed services.

    Don't give this number & email to ANYBODY else. Don't register it's UPI except on self bank app or BHIM app of NPCI.

    3) Secondary mobile numbers & emails - use for all calls/sms/all other websites registrations/secondary day-to-day usage bank account.

    4) Whenever amount needed, transfer from primary account to secondary account. Don't use primary account for any bank transfer except for self secondary account transfer.
    Also don't keep large amount in secondary account. My suggestion is to keep amount for 1 month expenditure only.

    5) Follow basic security guidelines (diff. Strong Passwords, not using unsecured/unknown devices, not sharing OTP/banking credentials)

    6) lock aadhar biometric.

    Or for any reason aadhar biometric can't be continuously locked, then link your secondary bank account to it.

    Beware that when aadhar linked mobile number lost, then need to get replacement SIM using other documents only. My advice is to use aadhar as less as possible.
    7) in the unfortunate event of your any bank account getting freezed/amount lein, immediately withdraw remaining amount through branch/ATM. DO NOT  do online transfer to any account.
    8) Incoming transactions to primary accounts shouldn't happen from secondary accounts/ other individuals. Only self cash deposit/salary/or any institutional sources.

    Seems like the bank is at fault here, write to the principal nodal officer of the bank and ask him why they put 3 liens on a single miscredit.

    Even if the bank had received 3 different hold notices from 3 departments, they could have informed the other departments they had already put a lien on the disputed amount. But they put your money on hold as well. Demand them nodal officer to remove the lein on your money and ask them to expedite the process on that lady's problem.

    Wait 30 days, hopefully you will get a resolution, if not approach rbi ombudsman. Always stress the point on 3 liens. Hope it helps.

    Key Understandings

    The first thing one needs to do in case of an incorrect money transfer is to inform the Bank by providing them with all the details of the transaction resulting in a request or complaint number  But then it is also understood that at  times it's not Feasible(sometimes due to multiple accounts)

    Above applies while Sending a payment to the wrong account or Receiving an unentitled payment

    Generally banks takes your consent before proceeding to reverse the payment made in error to its rightful owner But at times they either reverse the transaction during corrections (mistakes by Bank) or Refund to Source Party upon Law complaints (with just an intimation to you without further consent) 

    Be careful, identity theft and fraud comes in many shapes and forms. Also, it could be a simple mistake of a deposit going in the wrong account which has been known to happen from time to time

    Key Actions NOW

    Carefully review the transaction details to determine where the funds are coming from. This will help you understand if the funds are legitimate or if there has been a mistake(deliberately)  

    Keep a record of all communication with your bank regarding the unexpected funds

    Suggestion is to not call the Source Depositor unless Bank/Cyber Cell authorities make a move for all Party discussions.

    Neither receive any call from Depositor Party (Hoping its not a Money Mule case)

    Now as you have said that you had already made a discussion with Banks regarding 3x incumbrance/lien but Make a complaint regarding same over COMPLAINTS Portals/Emails for Grievance Redressal & take it further to next level officials  & RBI.

    If there is no personal agenda in this incident , then simply communicating that woman personally or through a lawyer is the simplest way to go. If you don't want to contact that lady, then 

    1)Why don't you raise grievance with icici? Check here. Attach all 3 complaint copy and highlight upi reference number in all 3 is the same. & you're liable to refund only 36k not 36*3. Hence ask icici to merge all 3. To put lien on 36k only & remove the other two as they are repetitive for same incident.

    2) send a legal notice through a cheap lawyer. That you're liable to pay 36k, which you'll refund provided the duplicate complaints(police/cybercell) are withdrawn and icici complaint closed. This way you won't hv false fraud label.

    3)if you don't need the amount immediately then keep calm and relax. Eventually you'll get a call from concerned people, tell them incident. & close the matter. 

    4)if you have time, you can file countercase through lawyer and get some compensation through court. But remember, time is money.

    I also want to remind you that health is wealth. Don't take this personally and get stressed. If one has  not done anything wrong, then there is no reason one must get stressed.

    I always check every notification in my Mobile every minute.

    So that necessary funds can be shifted to another account when required.

    There is no way police can find where exactly the money gone after shifting from ICICI. Even ICICI will take time to reach another bank for requesting Lien.

    this is the curse of upi which nobody talks about 

    in similar cases people faced huge issues when their whole account was frozen by cyber police cz they received money from some account who received money from fraudsters, they had to travel to other state to resolve the issue
