Anyone Transferred PF from Trust ( Exempted) to Non-Exempted ( Govt PF office)

Please reply back. I remember @panchabhut has some experience, can you please respond?

I have query on Trust to Govt. EPS Transfer using Form -13(?) and my PF claim getting rejected

What do you mean by "Govt PF"? Non-exempted employer acct directly maintained with EPFO?

Thanks for responding.

Here is the situation of my friend.


He worked for company X for about 12years and the company X is exempted aka trust. He opted to withdraw his EPF from this company.

After 3 months he received EPF amount and EPS schema certificate with his service mentioned.


Later ( around 6 months after his first company) he joined another company Y which is non-exempt ( with new PF account but same UAN) and while joining he did not handover this EPS certificate received from previous employer X and continued there for about 7 months. He quite this Y company as well 6 years back.


While he is trying to withdraw only PF amount (accrued from company Y) online the claim has been rejected 3-times since 2022 with reasons

1. Transfer previous service by applying form -13

2. contribution missing to be clarified though employer, if any ncp update then reapply claim.


Reason 1 : mentioned when he applied in May'2022 with form 19

Reason 2: when he reapplied in Jan'23 with form-13.


Now he wrote emails and tried to call RPF but no one replying or picking up calls.


Do you know how to proceed to 

1. Withdraw his PF and add this 7 months service to original 12yrs odd service (he has EPS service certificate).

Issue is due to EPS. He was earlier member of EPS in Co. X. So he should continue to be member of EPS in Co. Y. Has his EPS contribution got deducted during that period? As he was with non-exempted trust, both EPF and EPS should reflect in EPFO acct stmt.

NCP (no contribution period) relates to EPS and refers to period where EPS contribution is not due on acct of no salary etc.

What is the present status of employment? If presently employed with any organization having EPF, balance cannot be withdrawn and can only be transferred.

Thanks for detailed response. As i mentioned earlier:

1. He was not employed for more than 3 months after company X , he withdrawn his PF and got EPS certificate in lieu of his ~12yrs contribution to EPS
2. After 6 months of quitting from company X , he again took employment in Company Y. However, he did not Submit his EPS certificate from company X to company Y, 
3. He has PF deduction in company Y ( and i assume 8.33% by deafult goes to PF & remaining to EPS) 
4. After 7 months he quit company Y as well and not employed since then.

So when he tried to withdraw the contributed PF from company Y,  it was rejected with above reasons.

Now the query

1. Since it is all to do with his EPS records, can he submit this certificate at respective EPFO by himself and get the company Y service recorded and get his new EPS service certificate and withdraw PF

Or

2. The old  EPS certificate has to be submitted to employer Y ( though not employed with them) and get it to be forwarded to respective EPFO.

What is the wayforward now to correct it and withdraw his Company Y contributed PF?

Can you please advice?

EPS was mandatory for those joining till Aug 2015. However, for those joining for the first time after Sept-2015 and having a Pf-salary of more than 15K, EPS is not applicable. But those who were earlier covered under EPS continued to be part of EPS even if their salary was more than 15K. So the date of joining in the second co is relevant. If he joined after Sept 15, since he did not link earlier scheme certificate, it is possible that the Co did not tick EPS while creating his acct. So need to verify whether EPS was actually deducted instead of "assuming".

If EPS was not deducted then in addition to linking scheme certificate, he would need to request adjustment of past contribution (plus interest) from EPF portion.

PF cannot be withdrawn till EPS issue is resolved

He quit company x in 2017, sept and joined company Y in march, 2018 .

Withdrew his pf in dec,2017 from company x ( which is exempt)  and got EPS certificate in dec,2017.

He quit company Y( non-exempt)  in oct,2018 due to ill health and now i am trying to handle and help him & his family due to his ill-health.

1. His pf-salary is morevthan 15k in both

2. He has not submitted his EPS certificate in company Y ( i will verify if EPS is ticked in company Y)

Now

1. Should he submit his EPS certificate to company Y ( he has the certificat3 with him now)  now and ask them forward to relevant EPFO?

2. Or can he directly submit the EPS certificate at relevant EPFO office by himself?

3. If no EPS deducted at company Y , can he pay the arrears and get the new EPS by adding company Y service?

Could you pls advice.

I tried contacting local EPFO, but they did not help much and simply said contact relevant office as soon as they verified details with his UAN. His EPFO office is chenbai south and they are not responding.

Due to ill health,bi am trying to help him withbthis.

I case of payments to Exempt trusts ,the proceeds will remain with the trust 

and may not receive a certificate from EPF.  The trust may issue a

balance certificate annually.

Since the fund is with the trust ,it may not be possible to withdraw from EPF

it should be the responsibility of the trust to transfer the funds  to EPF.

In case of transfer from EPF to trust   there are standard forms available with EPF.

Myy frnd has withdrwan PF from trust ( exempt) and EPS certificate from them. 

I am assuming if EPS certificate is given , the EPS contribution of 3.67% should have been transferred to EPFO under EPS scheme?

What i read from google is the EPS service certificate shoukd be handed over to next employer and they in-turn firward to EPFO.

But he is not employed with both anymore.

He is sick and i am trying to handle this on behalf of him for his family.
