You have video proof, so it will not be that difficult to proof in court.

Buy from flipkart with openbox delivery or go to apple authorised store to buy iphone... .4-5 thousand discount is not worth the  hassle and stress one takes if some misfortune happens , avoid online shopping for such high expensive items 

Amazon delivery getting more unreliable day by day, very sad to hear this unfortunate incident man

This is nearly foolproof scam done by agent. There is no way to pinpoint this to the agent and he can deny how much he wants. With a new phone with no apple ID no way to lock the phone.

Amazon should do something immediately.

Thought unboxing experience was ruined by Flipkart's new policy. But seems that's the way to counter these scams

People will scam you in the very first chance they will get.

Scamming is now reached to DNA level finally.

Amazon is running a fraud center nowadays. Flipkart is way better with open box deliveries. Nobody can escape that easily. My friend has to run around everywhere and beg everyone for his 40k refund for months of a broken tv he got from Amazon.

In unboxing video everything seems to be perfect and even iphone box seal seems to be good

"Since the delivery man is so called underprivileged & so called oppressed and the person receiving the iPhone is an elite, rich person, the delivery man has the right to steal from the rich man."......These kinds of incidents stem from this kind of deranged mentality / thought process, which unfortunately is being fostered by some individuals in our country. 🤦

Very unfortunate! BTW, why didn't you demand an open box delivery before sharing the OTP? Is it not available at your location? Thes e things are taking place coz some A.holes customers used to swap out new phones for old ones before requesting a return. That forced e-commerce companies to make return/refund policies more stringent. That fraud level has now been raised by delivery thugs & as a result, genuine customers suffer coz of all this $h!t.

Drag them to consumer court, make sure you have everything well documented, as the "activation date" point is a conclusive evidence, you will definitely get justice there.

It's alarming to see how these issues are being handled -hoping you get the resolution you deserve mate.

And funny part is Amazon Investigation team never contacted me during 3 times check of my refund request. Amazon never asked or took Unboxing video from me.

The only option we see when we raise wrong product request is to upload 3 pictures and let you write 160 characters in box.

That's why I am saying Amazon Unboxing videos are of no use. If you can't spontaneously fight with delivery agent and approach their hub and supervisor or police, forget your money.

I think you should go to police and give old lava phone imei number . If the phone  was used by any sim you can get the persons number and directly catch him. 

Have you contacted Apple support team on X ? 

Describe them the entire issue as you have all proof of purchase they might assist you

ask police to file fir, they will deny first. give them chai paani or take 20-40 people there and they will file it. then they will take that banned agent and his manager, now who will pay you back doesn't matter but you will get your money back. also tell police to track that phone.

Thats really scary..don't let this scammer escape bro file a case in consumer court if nothing works, you have solid proof and argument as he activated the phone on 17th itself. I have completely lost my trust in ecommerce for anything expensive. Sometimes i get really angry by seeing how openly most people try to scam..right from the veg seller to the top business everyone wants free money! Wish you get justice.

on topic - go with strong police complaint and cyber fraud complaint .. including bank chargeback .

Lesson : If its open box delivery with OTP, follow it as prescribed by the vendor, in this case its Amazon. If the agent is not comfortable with following the processes to the T, do not accept the product. I did this once with Flipkart as the delivery guy told me that he has not time and has bunch of orders to be delivered. I told him, no worries 'jab unboxing keliye time rahega tab aana deliver karne'.
