Sunfeast All Rounder Sweet and Salty Dream Kitchen Contest
Please read the terms and conditions (T&Cs) before participating in the contest. You agree that by participating in the contest, you will be bound by these T&Cs and you acknowledge that you satisfy all contest eligibility requirements as provided herein below.
For the purpose of these T&Cs, wherever the context so requires, “You” or “Your” shall mean any natural person who is participant in the contest and “We” or “Our” shall mean BigCity.
Persons participating in the Contest shall individually be referred to as "Participant" and collectively as"Participants".

1. Scope of Contest:
a. This is a limited period contest (hereinafter referred to as "Contest”) sponsored and launched by ITC Ltd (hereinafter referred to as “ITC” or “Company”) for selected packs specifying the applicability of this promotional scheme in the range of the following products: Sunfeast All Rounder Sweet & Salty having (a) MRP Rs. 5 of 34.2 g; (b) MRP Rs. 10 of 68.4 g; and (c) MRP Rs.30 of 171 g (individually “Product”, collectively “Products”). The Contest shall not apply to any Sunfeast All Rounder Sweet & Salty’s packs which does not have the label calling out the Contest.
i. For the rest of India (as defined below), The Sunfeast All Rounder Sweet & Salty Product covered under the Contest shall have the label expressly calling out the Contest and will have a pack code entitling the consumer to participate in the Contest.
ii. In Tamil Nadu, under this Contest for the Prizes as mentioned in 6(b)(i) and 6(b)(ii), Participants can participate via QR Code printed on the pack or by giving missed call on the number printed on the Product.
b. The Contest is being organized and managed by Premier Sales Promotions Private Limited(hereinafter referred to as “BigCity”).

2. Scope of Cashback:
a. The cashback can be redeemed on selected packs specifying the applicability of it in the range of its Product, Sunfeast All Rounder Sweet & Salty having MRP Rs. 5 of 34.2 g, MRP Rs. 10 of 68.4 g and MRP Rs.30 of 171 g. The Contest shall not apply to any Sunfeast All Rounder Sweet & Salty’s packs which does not have the label of the cashback. The consumers can redeem the cashback via QR Code printed on the pack or by giving missed call on the number printed on the Product.
b. Consumers will be entitled to an assured cashback amounting to what is printed on the said pack.
c. The offer is valid from 05/09/2024 to 03/11/2024 (“Offer Period”).

3. Eligibility:
a. This Contest is open for all Indian citizens residing in India in the states of Andhra Pradesh, Karnataka, Telangana, Kerala, Puducherry, Andaman & Nicobar (“Rest of India”) and Tamil Nadu:
i. who are eligible to enter into a contract under the laws of India;
ii. who are of age eighteen (18) years and above on the date of participating in the Contest.
iii. Only Indian citizens residing in India holding valid PAN CARD, AADHAR CARD, PASSPORT or VOTER ID CARD for verification purpose shall be entitled to participate under this Contest.
b. The Contest is not open for the employees of ITC and BigCity, their immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren), and our/ the BigCity’s affiliates, advisors, advertising/Contest agencies.

4. Contest Period & Contest Timings:
a. The Contest is valid only in India for a limited period of 60 (Sixty) days starting from DD/MM/YYYY at 00:00:01 a.m. to DD/MM/YYYY at 23:59:59 p.m. (herein after referred as "Contest Period"). ITC reserves right to cancel/reduce/amend/extend/modify the Contest Period at its absolute discretion without notice and without any liability, without assigning any reason whatsoever. No claims/questions shall be entertained in this regard.

5. How to Participate:
For Rest of India:
i. Step 1: Any Participant who has a Product and desires to participate, can scan the QR code printed on the Product or give a missed call on the number printed on the pack to get a link.
ii. Step 2: After scanning QR Code or accessing the link, the Participant will land on a whatsapp chat screen where they will be prompted with the option to accept the T&C of the contest or decline it. The consumer journey will end here if they decline the T&C.
iii. Step 3: Upon sharing consent to participate, Participant will then be presented with a list of states, upon which, they will select their state of purchase from a list.
iv. Step 4: Participants will then be prompted to enter the unique code printed on the pack to claim the assured cashback printed on the pack.
v. Step 5: Participants will then be prompted to select the mode of payment
vi. Step 6: After selecting their mode of payment, Participant will enter their UPI/NEFT details.
vii. Step 7: Participant will then receive the message, “Thank you for your details, you will receive your cashback within 24-48 business hours”.
viii. Step 8: Then Participant will be asked to answer a question and based on creativity, uniqueness and originality of the answer/entry, they will stand a chance to win Daily Prizes and Mega Rewards.
ix. After answering the question creatively, Participant will receive the message- “Thank you for participating for All Rounder Dream kitchen contest. You also stand a chance to win a new modular kitchen or exciting kitchen appliances. We will contact you if you are a shortlisted winner.”
x. This Contest is being organized on a "best effort" basis and participating in this Contest is voluntary.
For Tamil Nadu:
i. Step 1: Any Participant who has the Product and desires to participate, can scan the QR code printed on the Product or give a missed call on the number printed on the pack to get a link.
ii. Step 2: After scanning QR Code or accessing the link, the Participant will land on a whatsapp chat screen where they will be prompted with the option to accept the T&C of the contest or decline it. The consumer journey will end here if they decline the T&C
iii. Step 3: Upon sharing consent to participate, Participant will then be presented with a list of states, upon which, they will select their state of purchase from a list.
ii. Step 4: The Participant will be prompted to select two options. Option 1 will be to claim the assured cashback. Option 2 will be to enter the dream kitchen contest
iii. Step 5: After selecting Option 1, The Participant will then be prompted to enter the unique code printed on the pack to claim the assured cashback printed on the pack
iv. Step 6: Participants will then be prompted to select the mode of payment
v. Step 7: After selecting their mode of payment, participant will enter their UPI/NEFT details.
vi. They will then receive the message, “Thank you for your details, you will receive your cashback within 24-48 business hours”.
vii. If they select option 2, to enter the contest, they will be asked the question “What makes you an All Rounder?”
viii. Then they will then receive Thank You Message: “Thank you for participating in Contest: If you have unique code from pack, you can claim assured cashback” with a prompt to collect assured cashback amounting to what is printed on the said pack.
ix. The consumer will then be prompted to enter the unique code printed on the pack to claim the assured cashback amounting to what is printed on the said pack.
x. Consumer will then be prompted to select the mode of payment
xi. After selecting their mode of payment, consumer will enter their UPI/NEFT details.
xii. They will then receive the message, “Thank you for your details, you will receive your cashback within 24-48 business hours’’.

6. Prizes:
a. For the purpose of this Contest:
i. “Winners” means Participants who have won any of the Daily Prizes or Mega reward. For avoidance of doubt, all Winners will be announced based on creativity, uniqueness and originality of their entry.
ii. “Prizes” means the Daily Prize(s) or Mega Reward(s), as the case may be, won by Participant(s), details of which are elaborated in Section b (i), (ii), below.
b. Prize & Rewards:
i. “Daily Prizes” means the prizes declared by BigCity for a particular day of the Contest Period, in accordance with terms hereof. The Winner would be the Participant who has completed the participation in the campaign and fulfill all eligibility criteria laid off herein in the terms and conditions, the definition of a day being 00:00:00 Hrs to 23:59:59 Hrs for every day in the Contest Period. Each Winner of a Daily Prize would be contacted via Call by the appointed agency i.e BigCity with provisions set out in Section 7 below. The mobile number entered by the Participant at the beginning of the game would be considered for this purpose. The winners will be selected based on creativity, uniqueness and originality of their entry. For Daily Prizes, winners will win one of the following merchandises at the discretion of ITC: Refrigerator/Washing Machine/Microwave/Gas Stove/Air fryer/Sandwich Maker/Sandwich Toaster/Electric kettle/Mixer Grinder/Juicer Mixer Grinder/Hand Blender). The winners cannot choose any of the prizes and the allocation would be made by BigCity/ITC only.
ii. “Mega Rewards’’ means the prizes declared by BigCity for a particular month of the Contest Period, in accordance with terms hereof. The Winner would be the Participant who has completed the participation in the campaign and fulfill all eligibility criteria laid off herein in the terms and conditions, the definition of a month being 00:00:00 Hrs of the 1st Day of the contest to 23:59:59 Hrs of the 30th day for every month in the Contest Period. Each Winner of a Mega Reward would be contacted via Call by the appointed agency i.e BigCity with provisions set out in Section 8 below. The mobile number entered by the Participant at the beginning of the game would be considered for this purpose. The winners will be selected based on creativity, uniqueness and originality of their entry. For Mega Rewards, winners will be given 2 options of which they can choose one option as the Prize:
• Option 1: The Winner can choose to avail a voucher from Home Interior Designs E-Commerce Private Limited (“Livspace”) worth Rs. 5,00,000 (Rupees Five Lakhs) which can be redeemed only at Livspace experience centres for modular offerings and furniture. The validity of the voucher is two months. The voucher will be applicable for all the available modular offerings and furniture in such experience centre and can be redeemed once the winner presents the said voucher at the Livspace experience centres. The cities where Livspace is operational and has experience centres are as follows:
Bangalore, Hyderabad, Chennai, Pune, Mumbai, Coimbatore, Kochi, Mangalore, Mysore, Nagpur, Nashik, Vijayawada and Vizag.
• Option 2: The Winner can choose to receive a prize worth Rs. 5,00,000 (Rupees Five Lakhs). Big City will transfer the cash prize via RTGS/NEFT to winner bank account and UTR/transaction number will be shared with winner. The cash prize will be subject to statutory deductions under applicable laws.

c. Participants to take note of the following terms with respect to the Contest:
i. The Prize cannot be transferred, exchanged or redeemed for cash. In the event that the Winner does not accept/claim the Prize in the time and manner communicated by BigCity then the Prize will be forfeited by the Winner and for avoidance of doubt, cash will not be awarded in lieu of the Prize. Prizes must be taken as offered and cannot be varied. Any unclaimed Prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken in exchange for cash. This will include all cases covered in Clause 14 below.
ii. As determined by ITC, in its sole discretion, entries must meet the following guidelines:
• All entries submitted must comply with these Terms & Conditions and any Terms of Use of the Contest website;
• Cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, or contain nudity;
• Cannot promote alcohol, illegal drugs, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message;
• Cannot be obscene or offensive, endorse any form of hate or hate group;
• Cannot promote terrorist acts such as providing instructions on how to assemble bombs, grenades and other such weapons or provide instructional information about illegal activities;
• Cannot defame, misrepresent or contain disparaging or slanderous remarks about BigCity or ITC Limited, their customers or their products, or other people, products or companies;
• Cannot contain trademarks, logos or trade dress owned by others (except ITC Limited’s trademarks, logos or trade dress of the Product), or advertise or promote any brand or product of any kind (except the current Product as marketed by ITC), without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
• Must be original and cannot contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art, stills, or images published on or in television, movies, the Internet or other media, except such materials owned by ITC Limited) without permission and cannot be plagiarized from any source;
• Cannot communicate messages or images inconsistent with the positive images and/or goodwill to which ITC Limited or BigCity wishes to associate;
• Cannot depict, and cannot itself, be in violation of any law.

7. Delivery of Daily Prizes:
a. Winners for Daily Prizes will be based on creativity, uniqueness and originality of their entry from a pool of eligible and valid entries, as specified by BigCity. ITC or BigCity reserves the right to not declare the daily, Winners for a particular day, or month.
b. The Winner shall be responsible to comply with the registration process, related formalities and production of any /all such documents/information as may be required by the Company and the BigCity or authorities in connection with the Prize. The PAN card, Aadhar card, Passport, or Voters ID will be the documents based on which the verification will be done if necessary.
c. The Winners of Daily Prizes will be contacted by BigCity wherein the winners have to update their details such as name, mobile number, email ID, shipping address and other details. The call would be made within 96 hours of the end of the period pertaining to Daily Prizes of their winning date on their mobile number used for participating in the Contest as specified.
d. Winners will be required to respond to confirm eligibility and to provide verification documents within 2 days of initial contact to be eligible for the winner selection process. Winners will be required to share the verification documents as provided below:
i. Copy of anyone of the following being a valid Driving License or AADHAR or Passport or Voter ID Card as proof for identification and verification purpose only for all prizes
e. No Prize will be awarded if the information presented by the Participant(s) at the time of entering the Contest is not factually correct and Prizes are subject to Winner satisfying the verification process of BigCity.
f. A Participant who has won a Daily prize, once will not be eligible to win any other Prizes during the Contest Period.
g. The Daily Prize awarded to the Winner shall be delivered within 45 business days from the date of the relevant information for participation in the contest, being received by BigCity.
h. BigCity will send an intimation through E-mail/SMS when the prizes are dispatched to the Winners.
i. Any complaints regarding the non-delivery of the product should be made within 7 days from the time of dispatch (intimated through E-mail/SMS) of the products by BigCity.
j. As a practice, courier companies try to deliver the Daily Prize 2 times to the customer if at the first instance courier company couldn’t reach the customer for various of reasons such as (not limiting to) not at home, phone switched off, change of delivery address, wrong address etc. If the product is returned in such cases, BigCity will not be liable to dispatch the Daily Prize again.
k. BigCity will ensure to supply product merchandise (Refrigerator/Washing Machine/Microwave/Gas Stove/Air fryer/Sandwich Maker/Sandwich Toaster/Electric kettle/Mixer Grinder/Juicer Mixer Grinder/Hand Blender) in good condition, However, BigCity &?ITC?shall not be liable/responsible for any defect in the product. The guarantee and warranty of the product shall be transferred, as received from the Manufacturer / Distributor and all claims towards warranty need to be taken up with the manufacturer/distributor directly.
l. Daily Prizes once delivered cannot be replaced by ITC or BigCity under any circumstances.
m. No request for change in color, size, model etc. will be entertained by BigCity or ITC.
n. In the event of death of a confirmed Winner, no nominees or heirs or any other person shall be eligible to the Prize and no claim from the nominee or his/her legal heirs of the confirmed Winner or any other person shall be entertained for receiving the Prize.

8. Delivery of Mega Rewards:
a. Winners for Mega Rewards will be based on creativity in answering the said question from a pool of eligible and valid entries as specified by BigCity.
b. Prizes will be given subject to the Winner satisfying the verification process of BigCity.
c. The Winner shall be responsible to comply with the registration process, related formalities and production of any /all such documents/information as may be required by the Company and the BigCity or authorities in connection with the Prize. The PAN card, Aadhar card, Passport, or Voters ID will be the documents based on which the verification will be done if necessary.
d. The Mega Reward Winners will be contacted by BigCity wherein the winners have to update their details such as name, mobile number, email ID, shipping address and other details. The call would be made within 96 hours of the end of the period pertaining to Mega reward of their winning date on their mobile number used for participating in the Contest as specified.
e. Winners will be required to respond to confirm eligibility and to provide verification documents within 2 days of initial contact to be eligible for the winner selection process. Winners will be required to share the verification documents as provided below:
i. Copy of the following being a valid AADHAR and PAN Card for identification, verification, and TDS purposes only.
f. If the winners avail the Livspace voucher, all the Terms and Conditions as specified and communicated by Livspace (timelines, warranty etc.) to the Winner will be applicable.
g. No Prize will be awarded if the information presented by the Participant(s) at the time of entering the Contest is not factually correct.
h. A Participant who has won a Mega Reward, once will not be eligible to win any other Prizes during the contest period.
i. In the event of death of a confirmed Winner, no nominees or heirs or any other person shall be eligible to the Prize and no claim from the nominee or his/her legal heirs of the confirmed Winner or any other person shall be entertained for receiving the Prize.

9. Terms and Conditions for Assured Cashback:

a. This offer entitles consumers to an assured cashback amounting to what is printed on the said pack.
b. This offer entitles the end user cashback on their Bank Account Or UPI. The customer will be responsible for their choice of the cashback transfer method.
c. No claim shall lie for any redemption requests made after the expiry of the Offer Period.
d. The customer will be responsible for entering details such as UPI ID, Account Number etc. BigCity will not be responsible for any incorrect entries or details on the promotion website. No change in details will be entertained once you have submitted the request for cashback.
e. In no event shall BigCity or its partner agency be held liable for any issues relating to the redemption of the cashback including redemption request not being honoured by Payment processing partner.
f. In no event shall the maximum liability exceed the value of the cashback as the case may be.
g. The payment processing partner reserve the right to restrict cashback for any account with suspicious behaviour or invalid details/credentials. The cashback processing partner has the right to ask for documents to prove the customer/user identity.
h. The payment processing partner holds the right to refuse transactions deemed fraudulent as per their policies. In the event of any fraud detection, payment processing partner reserves the right to modify/change, discontinue, terminate, withdraw the Offer at any time during the Offer Period.
i. This offer is subject to promotional availability and government regulations.

10. Publicity:
a. By participating in the Contest, all Participants agree that ITC shall be at liberty to use the Participant’s name and/or photo and/or video and/or entry and that may appear in any advertisements/promotions/media coverage or publicity in any form which exists today or will be known anytime in the future, without any consideration to the Participant and/or the Winners. No fees or other sums are to be paid to the Participants or Winners on account of taking part in the aforementioned advertisements / promotions and they shall not raise any objection, protest or demur to such coverage or in this regard.

11. Intellectual Property:
a. All right, title and interest, including but not limited to the intellectual property rights, in the Contest and the promotional material(s), all data collected as a result of this Contest and in any and all responses received shall vest solely and exclusively with ITC at all times. ITC or any person or entity permitted by ITC in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant.
b. All material submitted in connection with the Contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to ITC upon submission and become the property of ITC exclusively. ITC may use the material in any medium in any manner it sees fit. Copyright in any such material remains the sole property of ITC.
12. Privacy Policy
a. When You participate in the Contest, we collect, receive, possess, use, store, handle, transfer, process and deal with your personal information which is provided by You. This information may vary but will typically include your information like first and last name, mailing address, complete date of birth, e-mail address, contact number, identity verification documents and details therein, etc. While doing so We collect, receive, possess, use, store, handle, process and deal with personal information from You that We consider necessary for the purposes of the Contest. The personal information is being collected by ITC/Big City and shall be retained by ITC/Big City
b. We may share Your personal information with our other corporate entities, affiliates, employees, agents, registered sellers, service providers that have been engaged for the purposes of the Contest. These entities, affiliates, employees, agents, service providers, may market to You as a result of such sharing unless You explicitly opt-out.
c. We may disclose personal information in our discretion, if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process as per applicable law. We may disclose personal information to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to: enforce our terms of use or privacy policy; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public as may be permitted by applicable law including the Information Technology Act, 2000.
d. We and our affiliates may share some or all of Your personal information with another business entity should We (or our assets) plan to merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of business. Should such a transaction occur that other business entity (or the new combined entity) will be required to follow this privacy policy with respect to Your personal information.
e. Whenever We transfer personal information to countries within or outside India in the course of sharing information as set out above, We will ensure that the information is transferred in accordance with this privacy policy and as permitted by the applicable laws including but not limited to Information Technology Act, 2000 and the rules framed thereunder.
f. The security of personally identifiable information or sensitive personal data or information is important to Us. We maintain administrative, technical and physical safeguards to protect against unauthorized use, disclosure, alteration or destruction of the personally identifiable information or sensitive personal data or information.
g. By participating in the Contest and/ or by providing Your information, You consent to the collection, receiving, possession, use, storage, dealing, processing and handling of the information You disclose to Us, including but not limited to Your consent for sharing Your information.
h. Your personal information may be retained and may continue to be used until: (i) the relevant purposes for the use of Your information described in this clause are no longer applicable; and (ii) we are no longer required by applicable law, regulations, legal obligations or legitimate business purposes to retain Your personal information.
i. The personal information collected in this contest will be used to declare the Winners on the website and to communicate promotional offers or information about products by ITC.
j. By participating in the Contest, the Participant agrees to allow ITC or the partner agencies to contact the Participant for the purpose of this Contest. Further the Participant agrees that the data received during the Contest by ITC may be used or shared with any agency for any further analysis/ promotion or marketing communications unless You explicitly opt out.
k. By sharing the information for receipt of cashback, i.e NEFT details or UPI ID, the Participants consent to the collection, storing, processing and use of such information by the BigCity or ITC or its affiliates, associates, agents, contractors and other third parties for the purpose of fulfilling the deliverables under the Contest. Such information shall be retained for the duration of the Contest and for a limited duration thereafter for the purpose of executing and facilitating the Contest.
l. Personal information given by the Participants shall be used to deliver Prizes. The personal information is being collected by BigCity and shall be retained by it as per applicable law, including RBI guidelines.
m. The Participants have an option of not providing the personal information as required under this Contest, provided that, in such cases, the prizes and cashback may not be provided to the extent permitted under applicable law. The Participants also have an option to withdraw their consent in relation to usage of personal information during the Contest Period subject to applicable law requirements. In such cases, the entry of the Participant shall not be considered and Participant shall not be eligible for the Prizes. The Participants may reach out to [email protected] for such withdrawals.
n. By participating in this Contest, the Participants acknowledge and consent to transfer and/or disclosure of their personal information by ITC to any third party authorised by ITC for providing services in relation to this Contest.
o. The sensitive personal data (including financial data) will be protected as per Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 and the related Reasonable Security Practices and Procedures would be complied with.

13. Agreement to Terms and Conditions
a. The Contest is subject to all applicable central, state and local laws and regulations in India.
b. The decision of ITC on matters related to Contest will be final and binding in all matters related to the Contest. No claims/questions shall be entertained in this regard.
c. ITC reserves the right to exclude any person from the Contest on grounds of (i) misconduct or criminal record; (ii) tampering with the entry process or the operation of the Contest; (iii) acting in violation of these terms and conditions; (iv) acting a disruptive manner or with intent to annoy, abuse, threaten or harass any other person; or (v) for any other reasons, as it may deem fit and proper. No communication in the regard will be entertained.
d. ITC shall not be responsible for any outage in the network services during the Contest Period.
e. ITC shall not be held liable if the Participants do not have mobile phones that support the Contest Weblink.
f. ITC and the BigCity shall not be responsible for (including but not limited to):
i. For any SPAM generated messages
ii. For the operator code (the code from which the SMS is received) not being displayed on the user's mobile phones
iii. For any SMS message delivery failures
iv. Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason
v. If the Participant has registered himself to the DND of the telecom provider/ the Participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign/contests. The Participant putting a missed call under the terms of this Contest is express consent on the part of Participant to exempt ITC and BigCity from DND restriction imposed by the relevant Participant.
vi. Other conditions beyond its reasonable control
g. By participating in the Contest, the Participant grants an exemption to ITC or BigCity from applicability of NDNC (National Do Not Call) Registry regulation for the limited purposes of communication on the Contest. Consumers who have won any Prizes under the Contest will be contacted by the BigCity for collection of further details to ensure delivery of the Prize and such Prize shall only be dispatched if the necessary information as requested for by BigCity have been provided. The Participant shall be solely responsible for any errors in such information provided.

14. General Conditions
a. Each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the Contest, the Participant warrants that all information provided by Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.
b. By participating in the Contest, Participant warrants and represents that it:
i. is the Participant’s original work,
ii. has not been previously published,
iii. has not won previous awards, (d) does not infringe upon the copyright, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity;
iv. The Participant will indemnify and hold harmless, ITC and BigCity from any claims to the contrary. Any Participant whose work includes likenesses of third parties or contains elements not owned by the Participant (such as, but not limited to, depictions of persons, buildings, trademarks or logos) must be able to provide legal releases for such use including BigCity’s use of such Entry, in a form satisfactory to administrator, upon request, prior to awarding of prize.
c. ITC and/or BigCity will not be responsible for any NDND (National Do Not disturb) Registry regulation. Participants may be contacted by BigCity for collection of further details to ensure delivery of the Prize and such Prize shall only be provided if the necessary information as requested for by BigCity has been provided. The participant shall be solely responsible for any errors in such information provided. You agree that for the purpose of processing any Prize, the BigCity may need to collect personal and/or sensitive personal information (“Personal Information”) from the Participant to ensure delivery of the relevant Prize. Such Personal Information shall be used and processed in accordance with provisions set out in Section 12 above.
d. ITC or BigCity shall not be liable to perform any of its/their respective obligations under the Contest or in respect of the Prize where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other force majeure condition, etc., and shall not be liable to compensate the Participant in these circumstances. ITC or BigCity shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Contest due to any government restrictions or any force majeure events including acts of Gods or any other circumstances beyond the control of ITC or BigCity.
e. The decision of ITC or BigCity, as regards the selection of Winners and distribution of the Prizes shall be final, subject only to ITC 's approval. No correspondence or any other claims whatsoever, in this regard will be entertained.
f. No queries, claims, dispute, complaints or grievances shall be entertained by ITC and BigCity after 5 business days from the date of the closure of the Contest.
g. Nothing contained herein amounts to a commitment or representation by ITC to conduct further contest of the same or similar nature as that of the Contest.
h. None of the provisions of these terms and conditions shall be deemed to constitute a partnership or agency between any Participant and ITC and the Participant shall not have the authority to bind ITC in any manner whatsoever.
i. ITC or any of its respective officers/employees/directors shall not be responsible for Participant not winning any Prizes due to delayed, lost, mutilated, corrupted or illegible documents etc. of the Participants.
j. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of ITC or BigCity.
k. ITC or BigCity accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of SMS, loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. ITC or BigCity shall not be liable for any consequences of user error including (without limitation) costs incurred.
l. If a Participant is dissatisfied with the Contest or the Contest rules and/or any content or any requirements of the Contest form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Contest.
m. Validity of Prize cannot be extended, or new Prize cannot be provided against the expired/unused Livspace voucher.
n. BigCity shall provide the Prize on an "as-is basis" and without any warranty or guarantee concerning the quality, suitability or comfort, and ITC and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency and/ or defect of any Prize or for any kind of consequential damages/ loss, in any manner whatsoever.
o. Only Indian citizens residing in the states of in Tamil Nadu, Andhra Pradesh, Karnataka, Telangana, Kerala, Maharashtra, Goa, Chhattisgarh, Puducherry, Andaman & Nicobar holding valid PAN CARD, AADHAR CARD, PASSPORT or VOTER ID CARD for verification purpose shall be entitled to participate under this Contest.
p. Gift Tax on Prizes will be borne by participant in accordance to the Income Tax regulations.
q. Any queries pertaining to the campaign, delivery of Prizes, cashback processing will not be entertained done during public holidays and bank holidays.
r. Only one numeric code per registration will be entertained. Multiple numeric codes cannot be entered together.
s. A maximum of one numeric code can be used per person, per mobile number, per email id, per account during the promotion period.
t. BigCity is acting as an executing agency for this promotional offer and holds no legal and financial liability on unclaimed offers, incentives, vouchers, etc beyond the applicable period of the promotional offer.
u. Under this promotion, the Prizes are being offered directly by BigCity. ITC is not responsible either directly or indirectly with respect to any matter pertaining to the cashback and the prize offered in this contest.
v. BigCity shall not be liable in any manner for any cost or expense incurred for the purpose of redemption of the cashback.
w. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of BigCity, including but not limited to technical difficulties, unauthorized intervention or fraud, BigCity reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any customer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
x. BigCity is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
y. Any attempt to deliberately damage BigCity’s promotional website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, BigCity reserves the right to seek damages to the fullest extent permitted by law. If BigCity suffers loss or incurs any costs in connection with any breach of these Terms or any other legal obligation by an entrant, the entrant agrees to indemnify BigCity for those losses, damages, and costs.
z. ITC does not endorse the quality of any of the products or services being offered by the BigCity or by the cashback partners.

15. Release and Limitations of Liability:
a. ITC and BigCity shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, as a result of acceptance of any Prize or participation in the Contest.
b. ITC and/or BigCity accept no liability, whether jointly or severally, for any errors or omissions, on behalf of third parties in relation to the Prizes.
c. The Participant shall be solely responsible for any consequences which may arise due to his/her participation in the Contest by conducting an illegal act. Participant also undertakes to indemnify ITC and/or BigCity and/or their respective officers, directors, employees and agents (together “Indemnified Persons”) on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by BigCity the Indemnified Persons on account of such act on the part of the Participant.
d. In consideration of ITC allowing the Participant/s to take part in the Contest, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against ITC, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Contest or related to the Contest or the Prize of the Contest.
16. Dispute
a. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or ITC and/or BigCity, shall be governed and construed in accordance with the laws of the Republic of India. The courts of competent jurisdiction at Bengaluru have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Contest. Participation in the Contest is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including (without limitation) this clause.
17. Sponsor
a. ITC Ltd is a sponsor for the Contest and its Prizes and its liability as sponsor shall be limited to funding of the Prizes set out in these T&Cs (subject to all terms and conditions mentioned herein). The Contest shall be operated and conducted by BigCity and shall administer all the necessary formalities and procedures to give effect to this Contest and shall be solely liable for selection of Winner and distribution of Prizes and overall operation of the Contest.
