Terms and Conditions

These Terms and Conditions apply to the MakeMyTrip Italy Gift Cards (“Gift Cards”) sponsored by Havmor Ice Cream Private Limited, having its registered office at 2nd Floor, Commerce House 4, 100 Feet Road, Prahladnagar, Beside Shell Petrol Pump, Ahmedabad – 380 015, Gujrat, India (“Havmor”), under a co-branding arrangement with MakeMyTrip.

You may win the chance to avail Gift Cards by scanning the QR code on the 80 year celebratory Havmor pack and submitting your “favourite Havmor memory” as part of the 80 Years of Havmor Celebrations Campaign (“Campaign”) on the link allied to the QR code.

You acknowledge that you are Indian resident and citizen of the Republic of India and at least 18 years of age, possessing legal eligibility to be bound by the terms and conditions mentioned herein. If you are a minor or below the age of 18 years who wishes to avail the Gift Card, kindly pursue such a chance with the knowledge that such Gift Card may only be availed and redeemed by a person of legal contracting age (legal guardians or parents).

You shall, at all times, keep the 6-digit pin number and your Gift Card number strictly confidential and not reveal the same to any person or entity.

Havmor’s trademark (s) may be used in association with the Gift Cards on social media or any other personal use as long as the said use of the mark (s) are suggestive of the sponsorship or endorsement of the Gift Card by Havmor and you do not derive any commercial benefit from such trademark use.

The Gift card is valid for purchases made from MakeMyTrip only and is valid for a period of 12 Months from the date of issuance of Gift card. Please refer to the terms and conditions of MakeMyTrip governing the redeeming of such Gift Cards at MakeMyTrip T&C You may use the Gift Card availed by you in the manner provided thereunder.

The Gift card cannot be cancelled or exchanged for cash.

The Gift card validity cannot be extended under any circumstances.

Havmor will not be responsible for the quality, fitness, standard, availability, etc. of the service provided through the Gift Card.

Havmor will not be responsible for cancellation of bookings (made pursuant to redeeming of Gift card) within validity, amount reimbursement as a result of such cancellation, or any other operational queries relating to redeeming of Gift Card.

Havmor is not responsible if a Gift Card is lost, stolen, destroyed or used in an unauthorised manner.

Havmor reserves the right to change these Gift Card terms and conditions from time to time in its discretion and without prior notice to you. All terms and conditions are applicable to the extent permitted by law.

Havmor may maintain the beneficiary details of the end user who receives and/or redeems such Gift Card and undertakes to share such beneficiary details whenever requested by MakeMyTrip/Reserve Bank of India/or any other regulatory authority as per privacy best practices.

Havmor is not responsible for security breaches on the MakeMyTrip systems and processes and the resultant impact on the integrity and confidentiality of your personal information.

“Havmor” is brand sponsor in this campaign and will not be liable for any discrepancy that may be raised under this campaign. No monetary claims against the Gift Card will lie against Havmor once Havmor has made full and final payment towards sponsorship of the Gift Card to MakeMyTrip.

Any charges, fee, duties, taxes pursuant to the Gift Card shall be borne by the consumer alone and will not be the liability of Havmor.

Havmor is not responsible for the content published on MakeMyTrip platforms- its accuracy, representation and integrity among other aspects- published on MakeMyTrip platforms, including but not limited to their app and website.

By participating in the Campaign, You give Havmor and/ or its affiliates, employees, etc. permission to use your name, likeness, images, videos, voice, appearance and the like as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like (“Publicity Material”), provided or taken or made in a manner authorised by Havmor, in relation to the Campaign and any promotions, events, or Campaigns to follow. You agree that Havmor and/or its affiliates have the right to publish Your saved item details/Publicity Material for any communication, promotions, events or Campaigns of Havmor and/or its affiliates that follow. You agree that Havmor and/ or its affiliates have complete ownership of Publicity Material, including the copyright therein, and may use them for any purpose. These uses include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements, and any promotional or educational materials in any medium now known or later developed, including the internet. You acknowledge that you will not receive any compensation for the use of the Publicity Material, and hereby release Havmor and/ or its affiliates and its agents and assigns from any and all claims which arise out of or are in any way connected with such use.

Havmor is not liable for security and integrity of any financial information or any other sensitive personal data you share with MakeMyTrip as part of the process of redeeming the Gift Card.

You hereby authorize Havmor to use the personal data shared in connection with the Campaign for fulfillment of purposes under the Campaign.

Any attempt to deliberately damage any Havmor website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this Campaign may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, We reserve the right to seek damages to the fullest extent permitted by law.

We, in our sole discretion reserve our right to exclude You from the Campaign, and/or to cancel all or part of the Campaign, without any liability on our part, if We believe You have (a) breached any of these T&Cs; (b) acted or have the intention of acting in a dishonest or fraudulent manner, or in bad faith; (c) tampered with the entry process or the operation of the Campaign; (d) acted in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person; (e) participated in violation to any law as may be applicable to your area / region or state within India.

Havmor and their officers, directors, employees accept no liability and shall not be responsible and/or liable in any manner whatsoever in case you are unable to submit your story for any reasons whatsoever including due to failure on the part of the facility provider, internet issues, device compatibility, capacity constraints. etc.

These terms and conditions are governed by and construed in accordance with the laws of India. You and Havmor each agree to submit to the exclusive jurisdiction of the courts at Ahmedabad. You agree to indemnify Havmor for all claims brought by a third party against it or its affiliates arising out of or in connection with a breach of any of these terms and conditions.
