Bitcipher Labs LLP (“CoinSwitch” / “Us” / “We”) is hereby offering the opportunity to participate and get rewards (“Rewards”) as constructed at the sole discretion of CoinSwitch, through its giveaway program (the “Program”) as per the terms contained herein (“Program Terms”). "You" or "User" shall be an individual who participates in the Program. These Program Terms govern Your participation. We reserve the right to amend or terminate the Program and/or Program Terms at any time, for any reason without prior notice or any liability to You. The User hereby agrees and acknowledges that upon participating in the Program, the User shall be bound by these Program Terms, as updated, modified, and/or replaced from time to time at the sole discretion of CoinSwitch without any prior notice to You. You are advised to review these Program Terms on [https://crypto-support.coinswitch.co/s/article/...] for any such amendment, replacement, or changes to the terms contained herein and any future use or access to any services covered herein. The User hereby agrees and acknowledges that upon participating in the Program, and/or any other information, service, or feature governed by Terms of Use (“Terms”) and/ or Program Terms contained herein, the User shall be bound by the Terms and these Program Terms, as updated, modified, and/or replaced from time to time at the sole discretion of CoinSwitch without any prior notice to You. These Program Terms incorporate by reference and supplement the Terms, the KYC-AML Policy the Trading Policy and the Privacy Policy.

Capitalized terms used but not defined herein shall have the meanings given to them in the Terms and/or the Trading Policy and the Privacy Policy. In the event of a conflict between the Terms and these Program Terms or the Trading Policy or the Privacy Policy and these Program Terms, these Program Terms will prevail to the extent of the conflict.

Eligibility Criteria: To participate apart from the Eligibility Criteria as contained in the Terms, you must:
Be an individual residing in India.
Be 18 years of age or older.
Confirm that your participation is not prohibited by any applicable laws.
You do not reside in a state wherein your participation under this Program is prohibited, including but not limited to such prohibition flowing from any state laws, rules, regulations and/or guidelines. Any Rewards provided to You by virtue of Your unauthorised participation in this Program shall stand null and void and CoinSwitch reserves the right to cancel and/or claw back any such Rewards.

Program:
A. Entry: Scan the QR code and provide your full name, phone number and email address.
B. Quiz: You'll be asked to answer a few qualifying questions. Correct answers give you a chance to receive but do not guarantee a Reward.
C. Attempts: If You are an existing User of the CoinSwitch app and have registered Your full name, phone number and email address on the app, You may, at the sole discretion of CoinSwitch, receive 5 (Five) chances to receive a Reward otherwise, You may at the sole discretion of CoinSwitch, receive 3 (Three) chances to receive a Reward. However, if You are not an existing User of CoinSwitch, downloading the app and registering Your full name, phone number and email address on the app may, at the sole discretion of CoinSwitch, allow 2 (Two) more chances to receive a Reward.
D. Giveaway Selection: Scanning the QR code and answering the qualifying question/(s) correctly will take You to the giveaway page. There are a limited number of Rewards being given under the Program and the distribution of such Rewards shall be till stocks last or till the end of the Term of this Program.
E. Bumper Giveaway: A Few of the lucky participants shall get a chance to receive a bumper giveaway at the sole discretion of CoinSwitch.
F. Reward: The construction and the content of Reward that You may receive shall be at the sole discretion of CoinSwitch. If You are not an existing User of CoinSwitch, You are required to download and register on the CoinSwitch app to view the Reward provided to You. You acknowledge and agree that You shall not be allowed to perform any action with respect to the Reward, including selling the Reward provided to You, without completing all actions as mandated by the Terms, Trading Policy and KYC-AML Policy to Trade on the CoinSwitch App. This Program shall operate concurrently with all other existing reward programs administered by Conswitch. G. Notification: Winners will be notified immediately and the Rewards may be distributed to You at such time as may be decided by CoinSwitch at its sole discretion. You may view the Rewards received by You in the ‘portfolio’ section of the CoinSwitch app.

Disclaimers:
A. Force Majeure: CoinSwitch is not liable for any delays or issues caused by events beyond our reasonable control, such as natural disasters, government actions, strikes, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, or shortages of transportation facilities, fuel, energy, labor, or materials etc.
B. Prohibition: Participation in this Program is void where prohibited or otherwise restricted by law.
C. Right to Cancel or Withdraw: CoinSwitch reserves the right to cancel, terminate, modify or suspend the Program for any reason, including, but not limited to, infection by computer virus, “bugs,” tampering, unauthorized intervention, fraud, or technical failures of any kind or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Program. The decision of CoinSwitch to cancel, terminate, modify or suspend the Program shall be final in all respects.

Term: The term of the Program (“Term”) will begin at 12:00 a.m. on November 08th 2024, and end at 23:59 p.m. on Oct 15th, 2024. CoinSwitch, in its sole discretion, may amend the Term without any prior notice or liability to You.

Taxes
A TDS of 10% will be applied to Rewards under the Program and the same will be deducted at the time of crediting the Reward. Further, the TDS shall be deducted at a higher rate in case of non-compliance of linking of PAN with Aadhar and also in a case where the status is specified person as per Section 206AB of the Act in the Income-tax portal.

Data Protection:
You hereby acknowledge and agree and grant your consent to CoinSwitch to use your information per the Privacy Policy and to conduct the Program (which includes tracking Your attempts to receive the Reward and to check if You are a Registered User of CoinSwitch) and may send you emails or messages about CoinSwitch's services and promotions. You can opt out of marketing communications by using the link in our emails or contacting [email protected].

Disqualification:

CoinSwitch reserves the right to disqualify any Users from participation in the Program and cancel or clawback the Reward given under the Program at any time at its sole discretion, for any reason at any time, including but not limited to:

A. Violation of Program Terms or Applicable Law: If the User does not comply with or violates any of these Program Terms or otherwise fails to comply with any applicable laws (including, without limitation, through any failure to include any required statutory and regulatory disclosures or otherwise required by CoinSwitch).
B. Engage in Fraudulent or Suspicious Behavior: If CoinSwitch determines that such User is attempting to undermine the fairness, integrity, or legitimate operation of the Program in any way by cheating, hacking, deception, or any other unfair playing practices intended to annoy, abuse, threaten, or harass any other Users or any representatives of CoinSwitch.
C. Prohibitions to use automated methods to participate: Use of any affiliate website, affiliate network properties, automated systems, script, or macro to participate is strictly prohibited and will result in disqualification.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE PROGRAM. SHOULD SUCH AN ATTEMPT BE MADE, CoinSwitch RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.



Other Important Information:

A. No Guarantee: Participating in the Program does not guarantee you will receive a Reward.
B. Fraud Prevention: You acknowledge and agree that CoinSwitch may delay the giveaway of the Rewards on account of an investigation into any fraud, misrepresentation, or malfeasance of any kind by any of the Participants in the Program. If You find someone misusing the terms of this Program, You may let Us know by contacting Us directly at [email protected]. CoinSwitch will investigate the matter and take the necessary steps without prejudicing our rights and remedies available under the laws.
C. CoinSwitch's Decisions are Final: In case of any disputes, CoinSwitch's decisions are final.
D. CoinSwitch reserves the right to cancel the Reward and/or Program and any part of the Reward and/or Program upon any legal or regulatory directions.

Governing Law: These Terms are governed by the laws of India.

Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Program Terms, or the breach thereof, shall be settled as provided under the Terms.
CAUTION: Any attempt to undermine the Program may violate laws and will result in disqualification. CoinSwitch may take legal action, including seeking damages and attorney fees.
